This indenture made the
fourth day of March, in the year of our
Lord, one thousand eight hundred and one; between Conradt Luke Junior and
Elizabeth his wife of the first part and Leonard Ganvsevoort Esquire of the second
part; witnessed, that the said parties of the first part, for and in
consideration of the sum of one thousand five hundred dollars, lawful money of
the State of New York, to them in hand paid, by the said party of the second
part, (the receipt whereof is hereby confessed and acknowledged) have granted,
bargained, sold, remised, released and confirmed; and by these presents do
grant, bargain, sell, remise, release, alien, and confirm, unto the said party
of the second part, and to his heirs and assigns forever. All that certain lot of ground, with the
buildings thereon erected, Situate, lying and being in the first ward of the
city of Albany and bounded on the South by the House and lot of ground of the
Heirs of Johannes Van Sante, an the
North by a House and lot of ground of Volkert P. Douw, on the west by a
Gangway, an on the east by Washington Street, Containing in front along
Washington Street, thirty five feet, on the west along the Gangway thirty five
feet, and in length on both sides from east to west, one hundred and twenty
feet all would measure be the same more or less; and also all that certain
gangway or piece of ground containing in Breadth five feet, situated lying and
being in the City of Albany, in the rear of ground first above described, and
in length Seventy feet, together with fee ingress, aggress, and regress, for
him the said Leonard Gansevoort his heirs and assigns forever, as the said lot
of ground and Gangway were separately descried in two several deeds for Derick
Hilton, and Mary his wife to the said Conradt Luke Junior, dated the first day
of May in the year of our Lord, One thousand Seven Hundred and Ninety eight,
and the reversion and reversions, remainder and remainder rent, issues and
profits thereof, and every part and parcel thereof with the Hereditaments and appurtenances.
To have and to hold, all
and singular the said lot of ground and gangway unto the said Leonard
Gansevoort, his heirs and to the only proper use, benefit and behalf of the
said Leonard his heirs and assigns forever.
And the said Conradt for himself his Heirs, Executors and
administrators, doth covenant and agree with the said Leonard, his heirs and
assigns, that the said Conradt, now is the true and lawful and rightful owner
and proprietor of the above granted and demised premises with the Hereditaments
and appurtenances, and every part and parcel thereof; and also that he the said
Leonard his heirs and assigns, shall and may at all times forever hereafter
peaceably and quietly, have hold, occupy, posses and enjoy, all and singular
the above mentioned premises, that their and each of their hereditaments, and
appurtenances, and every part and parcel thereof, without the lawful let, suit,
trouble, hindrance molestation, interruption, eviction or disturbance of him the said Conradt Luke Junior, his heirs
and assigns, or any other person or
persons lawfully claiming or to claim by him or under him, them or any of them,
or by, from, or under any person or persons whatsoever; And also that the said
Conradt for himself and his heirs the premises hereby granted and every part
and parcel thereof with appurtenances, unto the said Leonard, his heirs and
assigns, against all and every person and persons whatsoever, shall and will
warrant and forever defend by these presents.

Be it remembered on the
ninth day of March one thousand Eight Hundred and one, personally appeared
before me Thomas Hun Esq., one of the Judges of the Court of Common Pleas for
the city and county of Albany, Coenradt Luke Junr. To me known, who
acknowledged, the he signed, sealed and delivered the within instrument, as his
voluntary act & deed for the uses and purpose therein mentioned & at
the same time appeared Elizabeth Luke, wife of the said Coenradt who being
examined, separate & apart from her said husband, acknowledged that she
signed, sealed and delivered the within instrument, as her voluntary act &
deed fro the purpose therein mentioned, without any compulsion, fear or threat
of her said husband at the same time Joshua Babcock to me known, who being
sworn says, that the said Elizabeth, no here present, is the person within
describe & I being satisfied with the proof & finding no erasures, or
interlineations, except such as are noted, do allow the same to be recorded.
